Judicial review proceedings have commenced against An Coimisiún Pleanála’s decision to grant Ardstone planning permission for 562 new homes at Milltown Park, Sandford Road, Dublin.

The proceedings have been brought by Cherryfield Avenue Residents Association and Dermot Murphy, represented by FP Logue Solicitors.

The permission, granted in August, provides for 562 homes, including 56 social homes, alongside a crèche, a café/restaurant, and community space on the 10.5-acre site. Ardstone acquired the site in 2019 and three successive schemes have received planning permission, each of which has subsequently been subject to judicial review proceedings.

The latest scheme incorporates revisions addressing concerns raised during the planning process and engagement with residents. These include a reduction from the 667 homes permitted under the original scheme to 562 homes, a reduction in maximum building height from 10 to eight storeys, and greater separation from neighbouring properties.

Mark Forrest, senior director at Ardstone, said: “It is deeply frustrating that the latest planning permission for Milltown Park is now subject to judicial review. Our objective remains to deliver 562 much-needed homes, including 56 social homes, on this well-located site. We have revised the proposals to address concerns raised during the planning process, reducing the number of homes and building heights, and increasing separation from neighbouring properties. This reflects our commitment to bringing forward a considered development that contributes positively to the surrounding area.

“We have two live planning permissions following decisions by Dublin City Council and An Coimisiún Pleanála. We are ready to build and could proceed to site in the absence of these proceedings. We have spent seven years working to bring new homes to Milltown Park. We respect the legal process and remain as committed to delivering this development today as we were when we acquired the site.”
